Terms of Service

These Terms of Service ("Terms") govern your use of the BiteSpaces platform operated by BiteSpaces Pty Ltd ("BiteSpaces", "we", "us", "our"). By accessing or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using BiteSpaces, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You have read and understood our Privacy Policy
• If registering on behalf of a business or organisation, you have the authority to bind that entity to these Terms

2. About the Platform

BiteSpaces is a marketplace platform that connects community space owners (such as schools, sports clubs, and community organisations) with mobile food vendors. We facilitate the discovery, booking, and management of space rental arrangements.

BiteSpaces acts as an intermediary platform. We are not a party to any agreement between space owners and vendors. We do not own, manage, or control any spaces listed on the platform.

3. User Accounts

3.1 Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information promptly
• Keep your password secure and confidential
• Use a strong password (minimum 10 characters with uppercase, lowercase, numbers, and special characters)
• Notify us immediately of any unauthorised access to your account

3.2 Account Types

• Space Owners: Organisations that list available spaces for food vendors
• Vendors: Mobile food businesses seeking spaces at community events

3.3 Account Security

You are responsible for all activities that occur under your account. We implement security measures including rate limiting, encryption, and multi-factor authentication support, but you must also take reasonable steps to protect your account.

4. Space Owner Obligations

If you list a space on BiteSpaces, you represent and warrant that:

• You have the legal right to offer the space for the intended use
• All listing information is accurate and not misleading
• The space complies with all applicable local council regulations, zoning laws, and safety requirements
• You hold appropriate insurance coverage
• You will honour confirmed bookings unless circumstances beyond your control prevent this
• You comply with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010)

5. Vendor Obligations

If you use BiteSpaces as a food vendor, you represent and warrant that:

• You hold all necessary licences, permits, and registrations required to operate a mobile food business in your jurisdiction
• You comply with all applicable Food Standards Australia New Zealand (FSANZ) requirements
• You maintain valid food safety certifications and public liability insurance
• You will comply with the specific requirements of each space and event
• Your business information and profile details are accurate

6. Bookings and Payments

6.1 Booking Process

• Bookings are subject to space owner approval unless otherwise indicated
• A booking is confirmed only when the space owner approves the request and payment (if required) is processed
• Both parties should communicate through the platform where possible

6.2 Payments

• All payments are processed in Australian Dollars (AUD) through Stripe
• BiteSpaces may charge a platform service fee as disclosed at the time of booking
• Payment information is handled securely by Stripe and is PCI-DSS compliant
• We do not store credit card numbers on our servers

6.3 Cancellations and Refunds

• Cancellation policies are set by individual space owners
• Refunds are processed in accordance with the applicable cancellation policy and Australian Consumer Law
• In cases of dispute, BiteSpaces may mediate but is not obligated to do so

7. Prohibited Conduct

You must not:

• Use the platform for any unlawful purpose
• Provide false or misleading information
• Attempt to gain unauthorised access to the platform, other accounts, or systems
• Interfere with the security or operation of the platform
• Scrape, harvest, or collect data from the platform without authorisation
• Upload malicious content, viruses, or harmful code
• Circumvent any security features or access controls
• Use another user's account without permission
• Engage in conduct that is harassing, abusive, or discriminatory
• Manipulate ratings, reviews, or feedback

8. Intellectual Property

All content, design, logos, and software on the BiteSpaces platform are owned by or licensed to BiteSpaces and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Content you upload to the platform (such as listing photos and descriptions) remains your property, but you grant BiteSpaces a non-exclusive, royalty-free licence to use, display, and distribute that content on the platform.

9. Limitation of Liability

To the maximum extent permitted by law:

• BiteSpaces provides the platform "as is" and does not guarantee uninterrupted or error-free service
• We are not liable for any disputes between space owners and vendors
• We are not liable for any loss, damage, or injury arising from the use of spaces booked through the platform
• Our total liability to you is limited to the amount of fees you have paid to BiteSpaces in the 12 months prior to the claim

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

10. Indemnification

You agree to indemnify and hold harmless BiteSpaces, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the platform
• Your breach of these Terms
• Your violation of any law or the rights of a third party
• Any content you submit to the platform

11. Suspension and Termination

• We may suspend or terminate your account if you breach these Terms
• You may close your account at any time through your account settings or by contacting us
• Upon termination, your right to use the platform ceases immediately
• We will handle your personal information in accordance with our Privacy Policy upon account closure

12. Dispute Resolution

In the event of a dispute:

1. Contact us at support@bitespaces.com.au to attempt resolution
2. If unresolved, the parties agree to attempt mediation in good faith
3. If mediation fails, either party may pursue legal remedies

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by email or platform notification. Your continued use after the effective date constitutes acceptance of the updated Terms.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BiteSpaces
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any provision does not constitute a waiver
• Assignment: You may not assign your rights under these Terms without our consent
